Terms of Sale
1. Scope
These terms apply to all purchases of digital content on fenikshub.eu from FENIKS MWM SP. Z O.O., Kobielska 17/17, 04-340 Warsaw, Poland ("we"). Terms version: 2026-10-01.
2. Contract
The product presentation is an invitation to order. By completing the payment you submit a binding offer; the contract is concluded when we confirm the order on the order page and by e-mail.
3. Prices and payment
All prices are final prices in the stated currency. Payments are processed by our payment service provider Whop inside our checkout page.
4. Delivery
Delivery takes place electronically: immediately after payment you receive access to a personal order page with a download button and an e-mail containing the link to that page. Each download link is generated on request and valid for a short time; the number of downloads per order may be limited.
5. Right of withdrawal and refunds
Consumers have a statutory right of withdrawal, subject to the rules in our withdrawal policy. For digital content not supplied on a tangible medium the right expires once we have begun performance after you expressly consented to this and acknowledged the loss of the right (§ 356 (5) BGB).
Independently of the statutory rules we refund the full price if you request it within 14 days of purchase and have not downloaded the file.
6. Licence
You receive a simple, non-transferable licence to use the content for personal or internal business purposes. Redistribution or resale is not permitted.
7. Liability
We are liable without limitation for intent, gross negligence and injury to life, body or health, and under the Product Liability Act. For slight negligence we are liable only for breach of essential contractual obligations, limited to the typical, foreseeable damage.
8. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only insofar as it does not remove protection granted by mandatory provisions of the law of the country of their habitual residence.
